The federal appeals court ruled on Tuesday that it would reexamine the case concerning the executive power with an larger panel of 11 judges. The court also vacated a previous ruling from a three-judge panel that had supported the federal government.

Ongoing Dispute Over Military Presence

This order represents the latest turn in a long-running court case over whether the former president has the legal right and justification to deploy national guard forces in Portland. Approximately two hundred troops have been in limbo since late September when the deployment effort was started in response to months of protests.

Differing Viewpoints

The federal government has argued that federal officials at the ICE facility in south Portland were facing threats, while city and state officials assert that local officers have command of the circumstances.

In defiance of descriptions of the city as a conflict zone, locals have been posting videos of scenic paths and a thriving food scene, and organizing events such as an Emergency Naked Bike Ride against the “militarization of our city”.

Recent Legal Actions

The Tuesday ruling came after a US district judge in Portland enacted two legal injunctions this period – one preventing the federalization of the Oregon national guard, and another stopping the deployment of any military personnel in the state, after efforts to circumvent the initial injunction by calling up out-of-state forces.

On the previous day, the appeals court had temporarily suspended the initial decision – allowing command of state troops – but the subsequent injunction remained in place, blocking the physical sending of the troops.

Full Panel Consideration

The latest ruling means the matter will be heard by the full court – with both rulings under review simultaneously – by a group of 11 judges.

“This ruling shows that facts are important and that the judicial system are working to hold this administration accountable. The constitution restricts the executive authority, and Oregon’s communities cannot be treated as a testing site for expansive government power,” stated the state attorney general in a statement.

“The judicial body is sending a clear message: the president cannot send the armed forces into American urban areas without cause. We will continue protecting state legislation, values, and autonomy as this case progresses and our fight continues in the courts.”
